Summary


Media companies operate in environments that provide extensive legal and regulatory obligations. In this context, media law refers to rules created by legitimate authority, such as federal, state or local governments. This set of rules comprises national constitutions as well as laws passed by legislative bodies and common law, as imposed by judicial bodies. The term regulation can be described as administrative law set up through the statute of legislative bodies, such as federal commissions. When conducting cross-border media operations, the legal dimension of the European Union will require attention as well. In context of a common EU market, providing free movement of goods, services, people and capital, particular media operations need to regard the underlying coherences, e.g. when considering conflicts where European interests may dominate national issues and regulations or vice versa. Types of media laws are not equal and have an order of precedence. The scope of legal issues ranges (amongst others) from prior restraint, libel, indecency, privacy, political and commercial speech up to the foundations of business laws.

Some specific problems arise in multimedia and broadcasting concerning the access to the customer. Different technologies exist such as satellite, mobile and fixed radio waves, copper network and cable. Fair competition must be guaranteed and access must in some cases be given to providers without own network. Companies with own network could abuse broadcasters and content providers by non-respect of net neutrality. In order to solve such problems, European and national laws foresee a complex set of ex-ante regulations, imposed by national regulatory authorities. The regulations also contain provisions on universal service and the management of bottlenecks like frequencies, internet domain names, numbering, etc.

This unit of our media management online training focuses on common factors that determine the legal framework for media operations on most national levels and examines both European and international aspects of media law and regulation. Apart from that, copyrightrelated laws and issues touching the process of content generation and delivery will be examined with a special focus.
